TikTok Ban in the U.S. Edges Closer, but the App Likely Won’t Vanish Overnight
TikTok’s future in the United States now rests with the Supreme Court, and the outlook for the popular app appears increasingly bleak.
On Friday, the Supreme Court heard arguments concerning a law that could lead to TikTok being banned nationwide. Signed by President Joe Biden in April, the law requires TikTok to sever ties with its Chinese parent company, ByteDance, or face prohibition in the U.S. Starting January 19, 2025, the ban could take effect unless the court intervenes.
During the hearing, several justices posed challenging questions to TikTok's lawyers, indicating a likelihood of upholding the law. TikTok argues the legislation violates the First Amendment, but the court’s reception suggested skepticism about this defense.
The details of how a ban would be implemented remain murky. TikTok’s legal representative, Noel Francisco, admitted uncertainty, stating, “On January 19, as I understand it, we shut down.” The app would likely be removed from app stores, preventing new downloads and updates for existing users. Over time, unaddressed bugs and vulnerabilities could render the app unusable.
The government might also compel internet service providers (ISPs) to block access to TikTok’s web platform, though this approach could prove more challenging due to the large number of ISPs compared to app stores.
Workarounds for Users
Despite potential restrictions, workarounds like virtual private networks (VPNs) could enable users to bypass the ban, a tactic common in countries with social media restrictions. In Turkey, for instance, VPNs are widely used to circumvent similar bans.
Is a Ban Permanent?
A TikTok ban may not be final. ByteDance could still sell the platform to a non-Chinese owner, as urged by U.S. officials. A consortium led by billionaire Frank McCourt and investor Kevin O’Leary has already expressed interest in acquiring TikTok’s U.S. operations, although ByteDance has repeatedly stated the app is not for sale.
The solicitor general suggested that the looming ban might push ByteDance to reconsider. “This might be the jolt Congress intended to prompt divestiture,” she told the court.
While TikTok may not disappear immediately, the app’s fate hangs in the balance as January 19 approaches.
